What the EU AI Act requires from August 2026
From August 2, 2026, the labeling requirement under EU AI Act Art. 50 applies to photorealistic AI images - including product photos in eCommerce, whether in your own shop, on marketplaces, or on social media.
Two obligations, two roles:
Machine-readable labeling (provider): AI-generated image files must be technically identifiable as such. The image models used by showcase embed machine-readable watermarks (e.g. SynthID); complementary metadata standards like C2PA are being implemented as part of product development.
Visible labeling (deployer): You as the retailer must add a visible notice like "AI-generated" to photorealistic AI images. This is exactly what the AI badge does: the notice sits right on the image.
Good to know: Violations of the transparency obligations can result in fines and competitor warning letters. Setting up your labeling process early puts you on the safe side - and builds trust with your customers.
