AI-generated images in Germany carry no third-party copyright. German copyright law (§ 2(2) UrhG) exclusively protects "personal intellectual creations" - an AI cannot be an author.

This means: There is no third party who can prohibit your use or demand licensing fees. Neither the AI provider nor an external author. This assessment is broadly shared by German legal experts and was also confirmed by a court ruling in February 2026 (AG Munich, case no. 142 C 9786/25).

The EU AI Act additionally regulates transparency obligations for AI content - more on labeling requirements below.

AI Act & Labeling Requirements

From August 2, 2026, the EU AI Act (Art. 50) requires labeling of photorealistic AI images. This also applies to product photos in eCommerce.

What this means for you:

showcase (as the provider) is responsible for machine-readable labeling in image files (e.g. via C2PA metadata). This requirement is being implemented as part of product development.

You (as the deployer) are responsible for a visible notice like "Created with AI" in your shop - if the images appear photorealistic.

Our recommendation: Prepare now. Document internally which images are AI-generated and develop a labeling process by the deadline. Those who communicate transparently early on build trust - and avoid legal risks.
